Nodal Terms of Use

Last updated 25 September 2026. Effective for all users from that date.

In short Nodal runs AI models on your own iPhone. The models are made by other people, they can be wrong, and you are responsible for how you use what they produce. Do not use the app to make anything illegal or harmful. Purchases go through Apple. We provide the app as it is, and our liability to you is limited to what you paid us in the last 12 months, or 50 euros if that is more. The full terms below are what actually applies.

1. This agreement

These Terms of Use (the "Terms") are a legal agreement between you and Cristiana Calota, an individual developer based in Romania ("we", "us", "Nodal"). They govern your use of the Nodal app for iPhone and everything that comes with it (the "App").

By downloading, installing or using the App you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

The App is distributed through Apple's App Store. Apple's Licensed Application End User License Agreement also applies. Where these Terms give you more protection than that agreement, these Terms apply between you and us.

2. Who can use Nodal

The App is rated for adults on the App Store because it runs third-party AI models whose output is not reviewed by anyone. You may use the App only if you are at least 18 years old, or the age of majority where you live if that is higher. By using the App you confirm that you are.

3. Your licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on Apple devices that you own or control, as permitted by Apple's usage rules, for your own purposes. You may use what the App produces for personal or business purposes, subject to section 4.

You may not copy, modify, distribute, sell, rent, sublicense, reverse engineer, decompile or attempt to extract the source code of the App or any part of it, except where the law expressly allows it despite this restriction. The open-source components inside the App are listed in Settings, Open source licences, and each one is available to you under its own licence.

4. Third-party models

In shortThe AI models are not ours. Each has its own licence, and it is your job to follow it.

The App itself contains no AI model. It runs open-weight models that you choose to download from public repositories, primarily Hugging Face. Those models are created and published by third parties, not by us.

Each model is licensed by its publisher under its own terms, shown on its row in Models and in Settings under Licences; the authoritative terms are those on the model's own page. Most are Apache 2.0. The Gemma 3 models are under the Gemma Terms of Use, which include Google's Prohibited Use Policy, and the Liquid AI models are under the LFM Open License v1.0, which limits commercial use to organisations with under 10 million US dollars a year in revenue. The image model and the music model are under the CreativeML Open RAIL-M licence, whose use restrictions apply to you: among other things, you may not use them to harm minors, to defame, harass or discriminate, or to give medical or legal advice presented as professional advice. Some licences restrict commercial use, redistribution or specific applications. You are responsible for reading and complying with the licence of any model you download or rely on.
We do not control third-party repositories. A model may change, move or be removed at any time, and downloads may fail or be slow for reasons outside our control.
We do not review, endorse or guarantee any model or its output, including models you find through the in-app search of community repositories.

5. AI output, and what it is not

In shortAI makes things up. Nothing the App writes is advice. Check anything that matters.

Text, descriptions, images, music and speech produced in the App ("Output") are generated by statistical models. Output can be inaccurate, incomplete, out of date, biased, offensive, or simply invented, and it may look confident while being wrong. The same prompt can give different answers.

Output is provided for information and creative purposes only. It is not medical, legal, financial, tax, safety, psychological or any other professional advice, and no professional relationship is created by using the App. Do not rely on Output for decisions that could affect your health, finances, legal position or safety, and do not use the App in an emergency. If you or someone else may be in danger, contact local emergency services.

You are solely responsible for evaluating Output before you use, publish or act on it. To the fullest extent permitted by law, we accept no responsibility for any Output or for anything you do with it.

6. Your content and your responsibility

Everything you type, attach, import or generate stays on your device. We do not receive it, store it or claim any rights in it. As between you and us, you own your prompts and your Output, to the extent the law and the licence of the model that produced it allow. Some models are trained on material that may resemble existing works; you are responsible for making sure that your use of Output does not infringe anyone's rights.

You are responsible for keeping backups of anything in the App that matters to you. Deleting the App deletes everything in it.

7. Rules of use

In shortNo illegal, sexual, abusive or deceptive content, and never anything involving minors.

You agree not to use the App, or anything it produces, to:

create, request or distribute sexual content involving minors, or anything that sexualises a minor, in any form. This is a zero-tolerance rule and may be reported to the authorities;
create sexual or intimate imagery of real people who have not consented to it, or images intended to deceive people about a real person;
harass, threaten, defame, intimidate or discriminate against anyone, or incite violence or hatred;
create, plan or facilitate anything unlawful, including fraud, malware, weapons or controlled substances;
infringe anyone's intellectual property, privacy or other rights;
circumvent, disable or interfere with the App's safety screening or any of its protections;
violate the licence of a model you run, or the terms of the repository it came from;
present Output as the work of a human where that would be deceptive, or as fact where it is not verified;
record, clone or imitate the voice of anyone other than yourself without their clear, prior permission, or use a cloned voice to impersonate someone, to deceive, to get around voice-based security, or to commit fraud;
publish images, audio or video made with the App that show or sound like a real person, or that could be mistaken for a real event, without making clear that they were generated by AI where the law requires it (including the EU AI Act) or where leaving it out would mislead.

Prompts for images are screened on the device and requests of the kinds above are refused. Screening is not perfect and does not change your responsibility for what you ask for.

7.1 Your own voice

The App can learn a voice from a short recording, made in the App or imported as an audio clip, and then read text in it. You may only record, import and clone your own voice, or the voice of a person who has given you their clear, prior permission and who can withdraw it at any time. You are solely responsible for having that permission, for how the cloned voice is used, and for any audio you make with it. The voice sample stays on your device and never reaches us, as the Privacy Policy explains; delete it in Voices, My voice, whenever you like, and always when the person whose voice it is asks you to.

8. Safety and reporting

Because the App runs entirely on your device, we cannot see your prompts, conversations or images and cannot moderate them. If the App produces something it should not have, or you believe someone is using it in breach of these Terms, use Report a concern in the App or email us at the address below. We take reports seriously and may use them to improve the App's screening.

9. Purchases and refunds

In shortNodal is unlocked by Nodal Monthly, a subscription that renews each month until you cancel and may start with a 3-day free trial, or by Nodal Lifetime, one payment. Apple handles the payment and any refund.

The App's tools are unlocked in one of two ways, both bought through Apple.

Nodal Monthly is an auto-renewing subscription. If you are eligible, it starts with a 3-day free trial; the monthly price is charged to your Apple Account when the trial ends unless you cancel at least 24 hours before it does. After that it renews automatically each month at the price shown, unless you cancel at least 24 hours before the end of the current period; your account is charged for renewal within the 24 hours before the period ends. You can manage or cancel the subscription in your iPhone's Settings, under your Apple Account, then Subscriptions. Cancelling stops the next renewal; the App stays unlocked until the end of the period you have paid for.

Nodal Lifetime is a one-time purchase that unlocks the App on your Apple Account for as long as we offer the App. "Lifetime" means the lifetime of the App, not yours or ours, and it does not entitle you to future products that we may sell separately. It does not renew. Payment is charged to your Apple Account at confirmation of purchase.

The price is shown in the App in your local currency and may change for future buyers; a change does not affect a purchase you have already made. A purchase can be restored on any iPhone signed in to the same Apple Account, from Restore Purchases on the unlock screen or in Settings.

If you are a consumer in the European Union or the United Kingdom, you may have a statutory right to cancel a purchase of digital content or services within 14 days. Purchases in the App are made through Apple, and that right is exercised through Apple under its terms, including at reportaproblem.apple.com. By starting to use features you have paid for straight away, you ask for immediate access and acknowledge that the right to cancel may be lost for digital content that has been fully supplied, to the extent the law allows.

All purchases are made through Apple, which is the merchant of record. We do not receive or store your payment details. Refunds are decided and issued by Apple under its policies; request one at reportaproblem.apple.com. To the extent the law allows, we do not issue refunds ourselves.

The App verifies purchases through a purchase-management service, as described in the Privacy Policy. If a verification is temporarily unavailable, the App keeps working from what it last knew.

10. Devices, performance and storage

Running AI models on a phone is demanding. Speed and quality depend on your device, on the model you pick and on what else is running. A model may not run, or may run slowly, on devices with less memory than it needs; the App tells you the requirement before a download, but cannot guarantee performance. Models take up several gigabytes of storage and running them uses battery and generates heat. You are responsible for choosing models suited to your device and for the storage they use.

11. Changes to the app

We may update, change, add or remove features, models, tools or catalogue entries at any time, and may stop offering the App altogether. We are not obliged to provide updates or to keep any particular model available. If we discontinue the App, purchased features will continue to work on your device for as long as the App runs on it, but we cannot guarantee compatibility with future versions of iOS.

12. Our intellectual property

The App, the Nodal name and logo, the design and all content that we created are owned by us or our licensors and protected by copyright, trademark and other laws. Except for the licence in section 3, nothing in these Terms gives you any right in them. If you send us suggestions or feedback, you agree that we may use them without any obligation to you.

13. No warranty

In shortThe App is provided as it is. We do not promise it is perfect, uninterrupted or fit for any particular purpose.

To the fullest extent permitted by applicable law, the App and all Output are provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement and quiet enjoyment. We do not warrant that the App will be uninterrupted, error-free, secure or free of harmful components, that any model will remain available, or that Output will be accurate, reliable, lawful or suitable for any purpose.

If you are a consumer, you have statutory rights that cannot be excluded, including rights under the laws of Romania and the European Union regarding digital content and services. Nothing in these Terms limits those rights.

14. Limitation of liability

In shortWe are not liable for indirect losses or for what you do with AI output, and our total liability is capped at what you paid us in the last 12 months, or 50 euros if that is more.

To the fullest extent permitted by applicable law:

we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, goodwill, data or opportunity, however caused and under any theory of liability, even if we were advised of the possibility;
we are not liable for any Output, for any decision or action taken in reliance on Output, for any third-party model or repository, for the acts or omissions of Apple, Hugging Face or any other third party, or for loss of or damage to your data, device or storage;
our total aggregate liability to you for all claims arising out of or relating to the App or these Terms is limited to the greater of the amount you paid us for the App in the 12 months before the event giving rise to the claim, and 50 euros.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for anything else that cannot be excluded or limited under the law that applies to you. In some jurisdictions the exclusions above may not apply to you in full; in that case they apply to the maximum extent the law allows.

15. Your responsibility for claims

You agree to defend, indemnify and hold us harmless from any claim, loss, liability, damage, cost or expense, including reasonable legal fees, arising out of your use of the App or Output in breach of these Terms, your violation of any law or of the rights of any person, or your breach of a model licence. This does not apply where and to the extent the law that applies to you does not allow it.

16. Ending the agreement

You can end this agreement at any time by deleting the App. We may suspend or end your right to use the App, without refund, if you materially breach these Terms, including section 7. Sections 4 to 7 and 12 to 19 survive termination.

17. Terms required by Apple

Apple is not a party to these Terms and is not responsible for the App or its content. The following applies as required by Apple:

These Terms are between you and us only. Apple has no obligation to provide maintenance or support for the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
We, not Apple, are responsible for addressing any claim by you or a third party relating to the App or your use of it, including product liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar laws.
If a third party claims that the App infringes its intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim, to the extent required by these Terms.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third-party terms when using the App.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

18. Governing law and disputes

These Terms are governed by the laws of Romania, and the courts of Romania have jurisdiction over any dispute, subject to the following. If you are a consumer in the European Union, the United Kingdom or elsewhere, you also benefit from any mandatory protections of the law of the country where you live, and you may bring proceedings in the courts of that country. Before starting any proceedings, please contact us; most problems can be sorted out by email.

19. General

Changes to these Terms. We may update these Terms from time to time. The current version is always at this address, with its date at the top. Material changes will be shown in the App or on this page before they take effect. Continuing to use the App after a change means you accept it; if you do not, stop using the App.
Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the App.
Severability. If any part of these Terms is found unenforceable, the rest remains in effect and the unenforceable part is replaced by an enforceable one that comes closest to its intent.
No waiver. If we do not enforce a provision, that is not a waiver of our right to enforce it later.
Assignment. You may not transfer these Terms. We may transfer them to a successor who takes over the App, with notice on this page.
Language. These Terms are written in English. Any translation is for convenience only.
